PrezSwipe (the "Service") is a gift-discovery platform available at prezswipe.com. The Service is owned and operated by Prez Ltd, a company registered in the UK under company number 17292006 ("we", "us", "our", "the Company").
These Terms & Conditions ("Terms") form a binding agreement between you and the Company governing your access to and use of the Service. By creating an account or otherwise using the Service, you confirm that you have read, understood and agreed to be bound by these Terms.
PrezSwipe helps you remember the people you care about and discover personalised gift ideas, including AI-generated suggestions. The features available to you depend on the subscription plan associated with your account.
You must be old enough to enter a binding contract in your jurisdiction, or have permission from a parent or guardian. If you register on behalf of an organisation, you warrant that you have authority to bind it. You are responsible for keeping your login credentials confidential and for all activity under your account, and you agree to provide accurate information and keep it up to date.

The Service uses third-party AI models to generate gift ideas based on prompts and any photos you provide. You are responsible for the inputs you submit (including having the right to upload any image) and for how you use the outputs. AI outputs may be inaccurate or unsuitable; you should review them before relying on them. We may filter, refuse or moderate outputs. You must not use the Service to generate illegal content, deepfakes, hateful or harassing content, malware, or to attempt to jailbreak underlying models. Repeat infringement of third-party rights may result in suspension or termination, and rights-holders may submit a takedown notice via the contact details at the end of these Terms.
Prez Ltd (or its licensors) owns the PrezSwipe software, branding and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You retain ownership of the content you upload; you grant us a limited licence to host and process that content solely to provide the Service to you.
Our order process is conducted by our online reseller Paddle.com Market Ltd. Paddle is the Merchant of Record for all orders placed on the Service and handles payment, billing, sales tax compliance, invoicing, customer service in relation to transactions, and refunds. These commercial mechanics are governed by the Paddle Buyer Terms, which apply alongside these Terms. Subscriptions renew automatically at the chosen interval until cancelled. You can cancel at any time; paid access continues to the end of the current billing period.
We work to keep the Service available and useful, but we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
We may suspend or terminate your access if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly violate our policies. On termination, your right to use the Service ends; you may request an export of your content within a reasonable period, after which it may be deleted.
To the maximum extent permitted by law, the Company's aggregate liability to you is capped at the fees you paid in the 12 months before the claim arose. We are not liable for indirect or consequential losses (including loss of profits, data or goodwill). Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited by law.
We may update these Terms from time to time. Material changes will be communicated in-app or by email. Continued use of the Service after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction, unless mandatory local consumer law gives you the right to proceed in your home jurisdiction.
